Incumbent may perform one or more of the following tasks based on assignments as directed:
• Responsible for County investigation programs of larger, regional, or statewide enforcement of fraud and product quality violations. This requires writing and presenting investigative reports, gathering, and evaluating the facts and evidence, locating and interviewing witnesses, taking statements and dispositions, providing and securing other expert support, and providing advice regarding test methods, scientific principles, business practices, and other technical and legal requirements contained in weights and measures laws.
• Determine the appropriate investigative scope and legal remedy for violations of weights and measures laws. Provide the necessary details and instructions for successful participation by other investigators, and direct them as needed, to complete a proper investigation.
• Confer with and support County District Attorneys and the California Attorney General, provide legal expertise on the accuracy of bulk commodity measurements depicted on weighmaster certificates, mislabeled, contaminated or adulterated automotive products, the use of unapproved or inaccurate weighing, measuring, or counting devices, unlicensed service agents, inaccurate quantity statements and labels on packaged items and inaccurate pricing on items sold. Identify and document fraudulent or negligent use, and the resulting harm to consumers. Present investigatory reports confirming violations found in the marketplace.
• Ensure compliance through criminal and civil actions as specified by the Business and Professions Code.
• Provide formal and field training, guidance, and coordination for county weights and measures officials responsible for enforcement of weights and measures laws and regulations. Instruct local weights and measures officials to understand, apply and properly enforce statutes, applicable to the particular industry and types of commodities represented and products sold. Instruct officials how to properly investigate regional businesses that use commercial measuring devices and how to remove non-compliant product from the marketplace.
• Direct and coordinate local and other investigators as necessary to document the scope of widespread violations. Demonstrate efficient and effective investigative procedures and foster professional enforcement programs at the local level and for all assigned counties.
• Review investigative work and reports of local officials, observe technical procedures, train, issue instructions, and advise on how to improve their work as required in the Business and Professions Code. Consult with each County Sealer to help identify and support effective and adequate levels for the enforcement program within each county.
• Conduct surveys of marketplace conditions at both local and regional levels and inform local jurisdictions of their relative condition and provide direction, assistance, and advice regarding benefits or needs, as required by the Business and Professions Code.
• Analyze needs in the development of program policies, guidelines, and regulations.
• Develop and evaluate technical program training materials, investigation procedures, technical and investigative training materials, and field operational documents.
• Draft written program correspondence, interpretations, positions, and inquiries. Inform management of requests, comments, and needs involving the public and local weights and measures officials.
• Maintain official program standards, equipment and tools.

This position is designated under the Conflict of Interest Code. The position is responsible for making or participating in the making of governmental decisions that may potentially have a material effect on personal financial interests. The appointee is required to complete Form 700 within thirty (30) days of appointment, on an annual basis, and upon vacating the position. The incumbent must complete an Ethics orientation training course within six months of assuming a Form 700 covered position, and every two (2) years thereafter, by December 31 of each numbered year. Failure to comply with the Conflict of Interest Code requirements may void the appointment.
